The 22-year-old suspect in a deadly shooting on Lester Avenue in Las Cruces, that prompted the shutdown of a nearby middle school on Wednesday, admits shooting the victim in self-defense.

In an interview with police, Bernardo Hernandez Jr. told Las Cruces law enforcement he shot and killed 24-year-old Elijah Daniel Venegas after he attacked him first, according to police documents.

According to police, Venegas was arguing with his girlfriend, when the woman messaged Hernandez Jr. to come pick her up.

Hernandez Jr. told police that after he arrived to pick the woman up, Venegas followed her into the car's backseat, where he hit her and then him.

Hernandez Jr. then said he pulled out a gun fearing that Venegas was reaching for a weapon as well, claiming he knows from experience that Venegas owns two guns.

Hernandez Jr. then admitted to police that he shot Venegas as he ran away from him-- claiming he felt Venegas posed a threat.

Furthermore, Hernandez Jr. admitted he fled the scene after the shooting, ditching the gun used on the Lynn Middle School campus which was nearby.

The middle school was forced to shut down and move students out as law enforcement looked for the gun.

Hernandez Jr. is being charged with first-degree murder (willful and deliberate) and tampering with evidence (capital crime or first or second-degree felony).
